Should I do a Short Sale to Avoid Foreclosure?

A short sale allows a mortgage lender to retake possession of the property for less than the amount still owed, leaving a possible deficiency judgment against you. This process requires lengthy negotiations aimed at convincing lenders that this is a better benefit to them now, rather than foreclosing and trying to sell later. In any short sale, it is recommended that you require the lender release you from the balance of the debt.

No, the discharge of a mortgage may eliminate your personal liability; however, a lender can foreclose if you fail to make mortgage payments. Yet, a lender may not hold you responsible for a deficiency judgment.
